New York bus accident attorney Jonathan C. Reiter discusses mechanical failure as a common cause of bus accidents.

NY Bus accidents can be caused by a number of factors including driver error and inclement weather conditions. However, there is a leading cause of serious bus accidents that isn’t typically recognized until months or weeks after an investigation has been completed: mechanical failure.

Earlier this year, a tour bus accident occurred in New York’s Time Square that caused 14 people to become injured, and resulted in the arrest of the driver.

“NEW YORK (CBSNewYork) – The driver of a double-decker tour bus that was involved in a crash with another bus in Times Square, injuring 14 people, was arrested Wednesday, but authorities have not decided whether to prosecute.”

According to media reports, the driver claimed that a problem with the brakes led to the crash; however, he was arrested on suspicion of driving while impaired. Weeks later, authorities determined that a mechanical failure did in fact cause the accident.

“NEW YORK (CBSNewYork) — The driver of the tour bus involved in a crash in Times Square this past summer will not face criminal charges.”

According to New York based bus accident attorney Jonathan C. Reiter, investigations are always important for determining the root cause of serious bus accidents, especially when a driver may be facing related criminal charges. It is important to have the correct facts not only to prevent an innocent person from being penalized criminally, but also so that personal injury victims know exactly who is at fault for their injuries in the event that they choose to pursue claims for damages.

Mechanical failure causes hundreds of bus accidents each year, and in many cases manufacturers or bus owners or operators are liable for damages sustained by victims. Mechanical failure immediately raises a question as to whether the bus was properly serviced and maintained. An attorney with experience in prosecuting bus accident cases can obtain the necessary records and information to show that negligent maintenance of the bus by the bus company was responsible for the mechanical failure of the bus on the road, causing serious injury or death to passengers.
